Our Personal Bankruptcy Practice

We handle all matters related to Chapter 7 and Chapter 13 bankruptcy filings, preparing all the documents necessary to complete the process and acting as your representative in all meetings or hearings with creditors, the bankruptcy trustee and the bankruptcy court.

When you hire us to help you with a bankruptcy filing, our first course of action will be to determine whether you qualify for the discharge of your debts under Chapter 7 or whether you must work out repayment plans with your creditors. Under the recent 2005 bankruptcy amendments, you must qualify to file for protection under Chapter 7 under the "means test."

If you qualify for a Chapter 7 filing, we will carefully explain which debts may be discharged, so that you can determine whether you want to proceed. Some obligations, such as student loan payments, child support arrearages and certain tax liabilities, cannot be discharged in a Chapter 7 filing. We will also make certain that any exempt property, including your principal residence and primary vehicle, is properly exempted from the estate.

If you fail to qualify for a Chapter 7 filing, we will help you file a Chapter 13 reorganization or "wage earner's" plan. By reorganizing your debts under Chapter 13, you can put a stop to foreclosure proceedings, keep personal property and repay your debt over time. We will also review any proposed reaffirmation agreements from your creditors to make certain they are within your means.

Whether you file for protection under Chapter 7 or Chapter 13, you will immediately be protected by the automatic stay, which prohibits creditors from contacting you by phone or by mail, or using any means outside of the bankruptcy to collect a debt. Depending on your situation, you can often put a halt to foreclosure proceedings and buy some time to renegotiate or restructure your mortgage.
